SUBSCRIBER AGREEMENT
These Terms and Conditions constitute an agreement between you and
SurfAnytime Ltd, 38 Queen Street, Glasgow, G1 3DX ("SAT").
These Terms and Conditions apply to the use by you of the SAT on-line
information, communication and other services provided by SAT (the
"Internet Services"), the different payment and connectivity
options (the "Access Options"), and access to information and
services provided by third parties (the "Third Party Service(s)")
and the use of the software program(s) (the "Software") and
any associated documentation which may be included in the delivery (the
"Accompanying Material") that you, the end user, are now
taking into use. The Internet Services allow you access to the Internet
and your use of the Internet is at your own risk and is subject to any
applicable laws. SAT does not accept responsibility for Third Party
Services obtained by you when using the Internet.
You should read these terms carefully. By completing the registration
request and by using the Internet, you agree to be bound by these Terms
and Conditions.
Bronze Option
1. The monthly subscription rate for this package is £9.99 (incl VAT)
per month. This will allow you flat-rate access to the Internet.
Flat-rate access to the Internet will be made available 24 hours per
day. You are entitled to access the Internet for a period of no more
than 60 hours per calendar month irrespective of the length of that
month, after which your account may become inactive until the beginning
of the following month.
Customer
usage will be monitored, should you approach 5 hours usage in any
one day, an automated email will be sent to your contact address warning
you of your usage. Continued use may invoke a temporary suspension
of your account. This suspension will be lifted at midnight on the
day it is set.
2. You can cancel your subscription at any time by email to
billing@surfanytime.com provided you give us 7 days prior notice.
Please note that if you cancel your subscription part way through a
month we will not refund any part of your subscription payment.
3. This access option is offered to domestic customers only.
4. You can only use this access option by calling from a BT line.
This access option cannot be used by mobile phone.
5. Upon registration you will be advised of your dial up telephone
number to use this access option. Please note that if you do not
correctly follow the downloading instructions, you will not get the
proper connection and you will be charged for Internet access usage
directly by your telephone service provider. You are responsible for
ensuring that your computer dials up using the correct telephone number.
6. You must not disclose your passwords or user IDs to any third
parties.
7. If you suspect that the password and/or user ID has been revealed to
a third party or that there has been any misuse of your account, you
must notify us immediately and seek fresh passwords and user IDs.
8. The dial up connection will be automatically disconnected after 2
hours of continuous connection regardless of activity. If you use
software or other methods to counteract cut-off measures SAT reserves
the right to terminate your subscription.
9. Should you wish to change from this access option to one of our other
access options you may do so by giving us 7 days written notice. Any
such change will be implemented on the date on which your next
subscription payment would otherwise have been made. A change of access
package can only be made once per quarter.
10. Our liability
We are not liable to you (whether as a
result of breach of contract, negligence or other tort or otherwise)
for:
Any damage or loss arising from the
consequences of our failure to
provide the Service in accordance with these terms and conditions; or
Loss of profit, any indirect or
consequential loss, loss of data,
business, or savings or for any wasted expense including but not limited
to
the cost of using any other service.
We are not liable for any failure to
perform our obligations if we are
prevented from doing so by an event beyond our reasonable control (which
may include, without limitation,
strikes; labour disputes; acts of God; war; riot; civil action;
malicious damage; compliance with any law, governmental or regulatory
order, rule, regulation or direction; any act or omission of any
government or other competent authority; accident; equipment or services
failure, including the unavailability of third party telecommunications
services, lines, or other equipment; fire; flood or storm).
11. All prices and costs quoted herein are inclusive of VAT and payment
must be made to us via credit card (Visa or MasterCard) or debit card.
We reserve the right to charge interest at the rate of 2% per month
above base rate of the Bank of England on any overdue accounts.
12. Under the Consumer Protection (Distance Selling) Regulations 2000, a
consumer may have the right to a 7 day ‘cancellation period’ in
relation to certain contracts. However, you acknowledge that you wish to
be able to connect to the Internet, using this access option, as soon as
is reasonably possible and as such you will not have any such right to
cancel this agreement during that period.
13. Please read these terms and conditions carefully to ensure that you
understand them. Once you complete your registration process, you will
have entered into a legally binding contract for the provision of the
access service.
14. We reserve the right to alter
these terms and condition as necessary.

Email
15.1) We do not back up individual mailboxes.
15.2) Email messages are removed from our servers
automatically when they are 60 days old. This
applies if the message has been read or not. You
must download your email onto your local machine to
prevent this.
